These Terms of Service (“Terms”) govern the use of the services provided by Visit Cozumel S.A. de C.V. (“Visit Cozumel,” “we,” “us,” or “our”). By booking a tour or using our website, you (“you” or “guest”) agree to be bound by these Terms.

If you do not agree with any part of these Terms, you should not use our services.

1. Services Provided

Visit Cozumel offers private Jeep and van tours in Cozumel, Mexico, designed primarily for cruise ship passengers.

Our services include private transportation, flexible itineraries, and optional activities such as snorkeling, beach visits, tequila tastings, and sightseeing.

2. Booking and Payment

  • Bookings are made securely through our online booking platform (e.g., FareHarbor).

  • Full payment or a deposit (depending on the tour) may be required at the time of booking to secure your reservation.

  • Prices are listed in U.S. Dollars (USD) unless otherwise stated.

3. Cancellations and Refunds

  • You may cancel your reservation for a full refund if you do so at least 24 hours before your scheduled tour time.

  • No refunds will be issued for cancellations made less than 24 hours before the tour, no-shows, or late arrivals.

  • Cruise Ship Itinerary Changes: If your ship does not arrive in Cozumel or if your itinerary changes and prevents you from participating in the tour, you are eligible for a full refund.

  • Refunds will be processed to the original form of payment.

4. Changes to Tours

  • We reserve the right to modify tour itineraries due to weather conditions, road closures, cruise ship schedule changes, or other circumstances beyond our control.

  • We will always strive to offer a comparable experience or an alternative arrangement where possible.

5. Guest Responsibilities

By booking with Visit Cozumel, you agree to:

  • Arrive at the designated meeting point at the agreed time.

  • Follow all safety instructions provided by our guides.

  • Inform us in advance of any medical conditions, mobility issues, or special requirements.

  • Carry valid identification, such as a government-issued ID or passport, if required.

Guests who are disruptive, behave dangerously, or are under the influence of drugs or excessive alcohol may be refused service without refund.

6. Liability and Assumption of Risk

  • Participation in our tours involves some risks, including transportation risks, outdoor activities, and exposure to the elements.

  • By booking, you voluntarily assume all risks associated with participation.

  • Visit Cozumel is not liable for personal injury, property damage, loss, or delays unless caused by our gross negligence or willful misconduct.

  • We strongly recommend that you purchase travel insurance covering excursions and unexpected cancellations.

7. Third-Party Services

Some components of your tour (e.g., beach club entrances, tequila tastings, snorkeling activities) may be provided by independent third parties. Visit Cozumel is not responsible for the acts, omissions, or negligence of these third parties.

8. Privacy

We value your privacy. Your information will be handled according to our Privacy Policy (available on our website or by request). By booking, you consent to our collection and use of your personal information as described in the Privacy Policy.

9. Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of Visit Cozumel S.A. de C.V. and may not be used, reproduced, or distributed without our written permission.

10. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of Quintana Roo, Mexico. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Cozumel, Quintana Roo.
